LIMITED WARRANTY AND LIMITATION OF LIABILITY

This warranty applies to all products sold by Comfort Home Distribution PTE Limited [CHD]

NOTICE: READ THIS LIMITATION OF WARRANTY AND LIABILITY BEFORE BUYING OR USING THE PRODUCTS CONTAINED HEREIN.

All Warranty, unless otherwise specified, has a total of 12 months of warranty from the date of purchase as listed on your sales docket. It is the responsibility of the customer to keep the sales docket safe at all times and this invoice must accompany any goods that require warranty claim for verification. This certificate warrants a service agreement between you, the customer and CHD; this contract is not a warranty of performance and cannot be considered as or similar to an insurance policy. It warranty is not transferrable and is only valid for the original owner.

Unless expressly stated, take into consideration the type of product purchased and its use under manufacturer specifications. Consumer products designed for domestic use are limited for domestic or personal use and not for commercial use and CHD warranty will be deemed null and void if evidence show otherwise.

This warranty does not under any circumstances extend to cover any loss or damage to a person or property, direct, consequential or incidental, arising from the use or inability to use the product, including any economic loss or loss of data or software, the extend that such may be disclaimed by law. CHD will not be responsible for any liability for any third party products or associated hardware, or customer-owned systems, equipment or software.

WHEN YOU BUY OR USE THESE PRODUCTS, YOU AGREE TO ACCEPT THESE RISKS.

CHD warrants to the original purchaser that the Products will be free from defects in material and workmanship, under normal use and regular service, and preventative maintenance for the duration of the warranty being provided for the particular product (“Warranty Period”). Should any failure to conform to this warranty be found during the Warranty Period, you must notify CHD of your claim within seven (7) days of discovery together with relevant documentation, and within the Warranty Period. Your failure to give notice of claims of breach of warranty within the Warranty Period shall be deemed an absolute and unconditional waiver of claims for such defects. CHD will charge costs of the repair to the customer if the item falls outside the warranty period or the terms of the warranty.

Upon notice of your claim, CHD will provide a repair authorization form, and further instructions on how to return the product for service. You must follow CHD instructions.
After receipt of a product which CHD determines is defective, CHD will, at its option, either repair (or authorize the repair of) the Product provided that the defect is claimed within seven (7) days from purchase. Due to the rapidly changing technology environment, parts may become obsolete / unavailable over time (end of life). In the event that a Product cannot be repaired due to unavailability of parts, CHD will use commercially reasonable efforts to obtain substitute parts or conduct work around design, but cannot guarantee its ability to do so.

Items not found defective will be returned at your expense, or failing receipt of instruction from you on return of such items within seven (7) business days of our notice to you that the product is not defective CHD may dispose of the product at its discretion and with no liability to you. CHD Company’s determination of defects is final. Products repaired or replaced during the Warranty Period shall be covered by the foregoing warranties for the remainder of the original Warranty Period.

Limitations:

This warranty is void in the event of misuse, alteration, faulty installation by you or a third party, infestation or misapplication of the product.

This warranty does not cover failure of product or components due to any ACT OF NATURE; lightning, floods or hurricanes, electrical surges or any other such catastrophic events.

CHD does not warrant any third party products or associated hardware or their performance or suitability for use and application. Such items are provided “as-is”.

All repairs must be authorized by CHD. Unauthorized repairs will not be reimbursed under any circumstances.

CHD is not required to make replacement or loaner equipment available while Products are being repaired or replaced, or to compensate you for any in/out labor charges or expenses associated with removal, handling or re-installation of the Products.

CHD must have prompt notice of any claim so that an immediate product inspection and investigation can be made. Buyer and all users shall promptly notify CHD of any claims, whether based on contract, negligence, strict liability, or other tort or otherwise be barred from any remedy.

Terms and Conditions
Furniture Purchases
If you are not satisfied with the appearance, fit or feel of your furniture purchase, you are entitled to a one-time exchange within seven (7) days of purchase (applicable delivery fees will be charged to you). If you have concerns about the condition of your purchase, our service team will work with you to correct the problem. Applicable delivery fees on merchandise returns will be charged to you. Guarantee does not apply to special order items, “as-is” or Clearance merchandise.

Soft Furniture (Bedding, Lounge, Upholstery etc.)
Mattress tops tend to rapidly wear when mattress protectors are not utilized. Customers are advised to use mattress protectors to safe guard against rapid wear. Any deterioration to mattress tops where protectors are not used is strictly not covered under warranty.
Should it be necessary to return your mattress or mattress set, store credit (less delivery charges) will be given only if it falls within 7 Days of purchase; there are no refunds on mattress purchases or Protect-All mattress protectors. Applicable delivery fees on exchanges or returns will be charged to you. A valid receipt is required on exchanges. Guarantee does not apply to linens, pillows, Protect-All mattress pads, adjustable bases, special order sizes, infested products, AS IS or Clearance merchandise.


Electrical Purchases
It is the customers responsibility to ensure that all electrical products are inspected and tested prior to receiving the products (signing the delivery signifies that goods were received in good order and condition; Refrigerators are an exception which must be left to stand for at least 6-8 hours after delivery before it is switched on)
Warranty is issued on hardware only. THERE IS NO WARANTY ON SOFTWARE. For any software issues, please contact the software support personnel and not CHD. This warranty does not cover failure of product or components due to any ACT OF NATURE; lightning, floods or hurricanes, electrical surges or any other such catastrophic events.

ABOUT YOUR ORDER
CHD is committed to your satisfaction. If you have any concerns about the condition of your merchandise, our team of service professionals will address your claim according to the following guidelines:
Visible Damage
While we take every step possible to handle your merchandise with care, occasionally damage does occur during shipping or handling. Please inspect your purchase promptly after you receive it and report any visible damage at the time of delivery.
Manufacturer Defects
CHD guarantees 30 days of free service on merchandise with manufacturing defects. Please report any defects to your local Comfort Home Distribution Limited Store within 30 days of delivery. After 30 days, any applicable delivery, service and repair fees will be charged to you. Upon receiving a claim, we will work with you to determine the appropriate course of action which may include one or more of the following:
1) inspect damaged merchandise in your home
2) provide service in your home or our warehouse at our discretion
3) repair the part or merchandise at our discretion.


EXCLUSIONS
We expressly exclude all responsibility for costs arising from the following, none of which are covered by our warranty.

Normal wear and tear.
Faults in any external wiring, electrical connection or plumbing which is not part of the product itself.
For damages caused by incorrect installation, connection or packing.
For damages caused by any use other than correct use described in the user manual, negligence, modifications, or use of parts that are not made or authorized by CHD.
For damages caused by faulty or unsuitable ancillary equipment.
For damages caused by accidents, lightning, water, fire heat, war, public disturbances or any act of nature and other cause beyond the reasonable control of CHD.
For products whose serial number has been altered, deleted, removed or made illegible.
If repairs or modifications have been executed by an unauthorized person.
Animal or insect infestation (including bed bugs) or intrusion.
Defects in the product brought to your attention before purchase.
Products are recalled by manufacturer, importer or government agency.

IMPORTANT NOTES:
1. Upholstery – Dye lots on display fabrics and sample swatches may differ from the products actually delivered by the manufacturer. Because leather is a natural material, surface marks and color variances are a sign the leather is genuine.
2. Wood products – Wood solids and veneers show unique variations in grain qualities on the same piece of furniture. Blemishes and imperfections are innate to real wood surfaces and demonstrate authenticity.
3. Warranties – Comfort Home Distribution Limited honors extended manufacturer warranties and will provide professional service in the event of any claims. Applicable transportation and service fees will be charged to you.
4. Warranty period for products are available in stores and will also be stated in your invoice at time of purchase.

REFUNDS
Check payments will be refunded by check a minimum of 10 business days after initial payment has been received. Cash payments will be refunded by check. Bankcard payments will only be credited back to the bankcard from which original payment was made. If that card cannot be produced for refund, you have the option of receiving a check in the refund amount, or leaving the balance “On Account” with Comfort Home Distribution Limited.

CUSTOMER PICKUPS
Hours for customer pickups vary by location. Please check with your store for details. Before picking up your purchase at the store or warehouse, please call the number provided by your sales associate at least one hour ahead and let us know you are coming. Your phone call will help us verify that your merchandise is ready and minimize potential waiting time for you. Should you need to exchange or return merchandise originally picked up, It will be your responsibility to transport the merchandise to and from the store or warehouse. Otherwise, a delivery charge will apply.

DELIVERIES
CHD honors your requested time of deliveries. However, due to unforeseen circumstances (traffic, road & weather conditions) delivery times may vary.
